Appeal Court has set aside Osun Election Tribunal’s Judgment nullifying governor Oyetola’s victory in a landmark decision by four of the five justices on the panel.
World Street Journal reports that the court of Appeal sitting in Abuja on Thursday set aside the judgement of the Tribunal which nullified the election of Governor Gboyega Oyetola.
In her lead judgement, Justice Hannatu Santey set aside the entire proceedings of the Tribunal based on what she described as the faulty composition of the Osun State governorship Election Tribunal panel.
She said the Appeal court should have returned the case back to the Osun State Governorship Election Tribunal for re-trial by a new panel. She however, added that the case is time bar, stressing that starting proceedings afresh at the Tribunal would not be a wise decision to make because time for proceedings cannot be expanded in a post election matter.
